- Home occupation permit required:
- Conditional
- Details:
- Kansas state law does NOT preempt local ordinances. Johnson County and its cities (Olathe, Overland Park, Leawood, etc.) may have home occupation permit requirements. Olathe and other Johnson County cities may require a home occupation permit for food production from a residential property. Johnson County has a food service permits program (via Wastewater/Environmental) but this appears to be for commercial establishments with grease traps, not cottage food. Contact local city zoning office for home occupation rules.
- Home kitchen:
- Almost all non-TCS foods allowed for direct-to-consumer sales. No state license, permit, registration, or food handler training required. No inspections. Some tested items (certain frostings, macarons, pecan pies, pepper jellies, mustards) may be allowed with prior product testing.
