Massachusetts residential kitchens are permitted by the local board of health. Pets are an inspector question, town by town.
105 CMR 590.009(G) (residential kitchens) is administered by city and town boards of health. There is no statewide “pets in a separate room” cottage-food statute. A local inspector can require animals out of the kitchen.
Residential kitchen permit = inspection. Food Code animal rules can apply.
This is one of the few states where the town packet can matter as much as the state code. Empty town notes stay empty.
