105 CMR 590.009(G) (residential kitchens) is administered by city and town boards of health. There is no statewide “pets in a separate room” cottage-food statute. A local inspector can require animals out of the kitchen.

Residential kitchen permit = inspection. Food Code animal rules can apply.
