How to start in Cayuga County

Permit, label, and local steps for selling under New York cottage food rules in Cayuga County. Not legal advice.

  1. Confirm your menu under state law

New York cottage food rules control what you may make at home (Non-potentially hazardous, shelf-stable baked goods (all must be baked), certain jams, jellies, preserves, snack mixes, and similar low-risk foods are approved under the Home Processor Exemption. All products must be pre-packaged in the home and labeled. Sales are permitted at farms, farm stands, farmers markets, green markets, craft fairs, flea markets, via home delivery, and online, but only within New York State.). Cayuga County cannot expand a food the state bans.

  2. Map channels and local sales rules

State sales cap: No cap. On-site / porch pickup in Cayuga County: Yes. Prefer markets or off-site pickup if residential customer traffic is restricted.

  3. Local permits, tax, and home occupation

Home occupation permit: Varies. Many places still need a general business license or tax certificate even when the state has no cottage food “permit.” Check planning, the clerk, and any HOA or lease before advertising your address.

  4. Training, registration, inspection

State registration: Yes. Local inspection in Cayuga County: No. Finish food handler training early — markets often ask for a copy.

  5. Labels that match the state

Print labels with New York disclaimer and allergen rules before market day. Use the free New York label page for the one-pager checklist and mockup.

  6. Insurance and first sales

Farmers markets often require a certificate of insurance. Soft-launch with pre-orders, keep a sales log, and re-verify rules if you change products or venues.

Label checklist

What usually goes on the package

  • Product name (common or usual name of the food)
  • Business or producer name
  • Producer address (or address alternative your state allows)
  • Ingredients in descending order by weight
  • Major allergen disclosures (e.g. wheat, milk, eggs, soy, tree nuts, peanuts, fish, shellfish, sesame)
  • Net weight or quantity
  • Home-kitchen disclaimer: “Made in a Home Kitchen”

Planning checklist only. Confirm with state and local agencies before you sell.

Citation: N.Y. Agric. & Mkts. Law §251-z-4; 1 CRR-NY 276.4
Verbatim excerpt

§251-z-4. Exemptions. In addition to the exemptions specified in subdivision three of section two hundred fifty-one-z-two, the commissioner may, if he determines that the protection of the consumers of the state as a whole will not be impaired by such action, provide by regulation for exemption from licensing of small food processing establishments when he finds that such exemptions would avoid unnecessary regulation and assist in the administration of this article without impairing its purposes. Regulations defining such exemptions may classify exempted establishments with respect to the volume and types of food handled, the types of processing involved, or with respect to any other factor or combination thereof which bear a reasonable relation to the purposes of this article. Such exemptions may be conditioned upon requirements relating to sanitation, record keeping and reporting as the commissioner may require.
