Do I need a Virginia cottage permit?
Under Va. Code § 3.2-5130, the home-kitchen exemption has no VDACS registration and no product-list review on that path. That is the state food rule. It is not a free pass on local zoning or a business license.
What does Chesterfield still require?
Some people ask for a county “cottage exemption” form. We have not found one. What shows up instead:

- Home occupation limits (for example, no more than two customers on site, household-only staff, no outdoor storage, size cap)
- A Planning zoning letter ($150, about two to three weeks in ELM)
- A business license with the Commissioner of the Revenue within 30 days of starting (under $10k receipts the license fee is $0 on the published schedule)
Some bakers say they had to send documentation and a product list and that review took several weeks. That language matches the optional state Home Food Processing (inspected) application, not the cottage exemption.
Can I sell cream cheese frosting on cinnamon rolls?
Some people ask for cream cheese frosting substitutes. VDACS treats cream cheese–based frostings as likely TCS.
