How to start in Franklin County

Permit, label, and local steps for selling under Idaho cottage food rules in Franklin County. Not legal advice.

  1. Confirm your menu under state law

Idaho cottage food rules control what you may make at home (Idaho allows all non-potentially hazardous foods except acidified foods. This broad category includes baked goods, candies, condiments (honey, mustards, nut butters, oils, syrups, vinegars), dry goods, pastries, most preserves (including jams and jellies), and snacks. Some borderline items like fruit butters may require health district approval.). Franklin County cannot expand a food the state bans.

  2. Map channels and local sales rules

State sales cap: No cap. On-site / porch pickup in Franklin County: Conditional. Prefer markets or off-site pickup if residential customer traffic is restricted.

  3. Local permits, tax, and home occupation

Home occupation permit: Conditional. Many places still need a general business license or tax certificate even when the state has no cottage food “permit.” Check planning, the clerk, and any HOA or lease before advertising your address.

  4. Training, registration, inspection

State registration: No. Local inspection in Franklin County: No. Finish food handler training early — markets often ask for a copy.

  5. Labels that match the state

Print labels with Idaho disclaimer and allergen rules before market day. Use the free Idaho label page for the one-pager checklist and mockup.

  6. Insurance and first sales

Farmers markets often require a certificate of insurance. Soft-launch with pre-orders, keep a sales log, and re-verify rules if you change products or venues.

Label checklist

What usually goes on the package

  • Product name (common or usual name of the food)
  • Business or producer name
  • Producer address (or address alternative your state allows)
  • Ingredients in descending order by weight
  • Major allergen disclosures (e.g. wheat, milk, eggs, soy, tree nuts, peanuts, fish, shellfish, sesame)
  • Net weight or quantity
  • Home-kitchen disclaimer: “This product is not subject to government food safety inspection or licensing requirements. It may contain allergens.”

Planning checklist only. Confirm with state and local agencies before you sell.

Citation: IDAPA 16.02.19 (Idaho Food Code, cottage food provisions)
Verbatim excerpt

STARTING A HOMEMADE FOOD OPERATION [from Eastern Idaho Public Health guidance implementing IDAPA 16.02.19]: Idaho has allowed for the sale of low-risk homemade foods for years through administrative practice. The Idaho Department of Health and Welfare has established that non-potentially hazardous foods may be sold directly to consumers without a food establishment license. Except for acidified foods, any non-potentially hazardous food is allowed. Some types of items, like fruit butters, apple sauce, and pepper jams, may be allowed depending on the recipe — contact your health district to get approval for products you are unsure about. Limitations confirmed: Direct sales only; interstate sales prohibited; perishable foods prohibited; no commercial kitchen use. Labeling: Foods that you produce in your home need to be clearly labeled on the product packaging; or by a clearly visible placard at the sales/service location that also states: 'The food was prepared in a home kitchen that is not subject to regulation and inspection by the regulatory authority; and the food may contain allergens.' Sales limit: unlimited (no sales cap).
